Customers while using this site are liable for safeguarding the privacy of their account and password and for restricting entry to their computer. They agree to take liability for all the activities that take place under their account and password. Flower Bliss Limited does not encourage transactions by children.
1. Our Products
1.1 All products are subject to availability. If the product ordered is not available, you shall be notified promptly and a substitute product may be offered subject to confirmation.
1.2 All efforts shall be made to ensure that the products are delivered “as displayed”, however, the product may vary because of craftsmanship, local traditions and availability of materials.
1.3 Where Flower Bliss is unable to meet your order as specified or offer a suitable substitution, Flower Bliss shall refund your payment in full within 5 working days via Mpesa or Card Reversal.
1.4 Some flowers may cause allergic reactions to the recipients. Flower Bliss shall not be liable for any damage caused by allergic reactions by the recipient or other persons in the vicinity of the products.
1.5 Flowers may be delivered in bud to increase vase life.
2.1 Prices displayed exclude VAT and delivery charges unless free delivery is explicitly offered.
2.2 Prices are valid as indicated on the website and may be subject to change without notice.
2.3 In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Flower Bliss shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. If payment has already been made for the purchase and your order is canceled, Flower Bliss shall immediately reverse the payment received.
3. Orders / Payment
3.1 Flower Bliss shall request relevant information for the purpose of fulfilling and delivering your order. All information provided by you shall be deemed to be correct and complete.
3.2 By submitting your order, you assent to being bound by these Terms and Conditions appearing here or anywhere else on the site.
3.2 Flower Bliss reserves the right at any time after receipt of your order to accept or decline your order for any reason. Flower Bliss reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item.
3.3 All payments MUST be made using the approved payment methods as indicated on this site. Any payments made to any other entity or person for products on this site, are made at your own risk.
3.4 All purchases shall be deemed to have occurred in Kenya. These Terms and Conditions shall be governed by and construed in accordance with Kenyan Law and the parties agree to submit to the exclusive jurisdiction of the Kenyan courts.
4.1 Delivery charges are applicable within the specified area. Requests for delivery to remote areas shall be charged at a premium rate to be confirmed by Flower Bliss upon receipt of your order. You shall be notified of all charges.
4.2 Orders for same day delivery must be received by 14:00 (2pm) EAT. Orders received on Sundays or Public Holidays shall be processed on the next working day. .
4.3 Flower Bliss will make every effort to ensure that delivery is made on the requested date. Where this is not possible, Flower Bliss shall make the delivery as soon as is practically possible.
4.4 Where a third party is involved during delivery, such as at the workplace, hospitals, schools or offices, the signature of any person authorized to accept delivery on behalf of the organization shall be accepted as proof of delivery to your chosen recipient.
4.5 Where Flower Bliss is unable to deliver an order due to the unavailability of the Recipient, Flower Bliss shall attempt as much as is possible to deliver the products. However if Flower Bliss is unable to make such delivery, it shall at all times be considered as a successful delivery and no refund shall be available.
4.6 Where Flower Bliss is unable to execute delivery due to missing information, incomplete address, order being refused by recipient, nobody available at address, not being able to find neighbours to accept delivery, the delivery shall be considered successful and there shall be no refund of the amounts paid in this instance.
4.7 It is the responsibility of the purchaser to ensure that the recipient is available to take delivery of the flowers.
5.1 Orders may be amended or cancelled up to 24 hours before the intended delivery date. Upon cancellation, Flower Bliss shall refund all payments made less than 20%.
5.2. Orders made for same day delivery, may be cancelled, however there shall be no refund of the purchase price.
6. Data Privacy
6.1 Flower Bliss shall ensure that it complies with the requirements of all current data protection legislations.
6.2 Flower Bliss shall use personal data received from you for the purpose of fulfilling our obligations under these Terms and Conditions.
6.3 Flower Bliss shall use personal data collected on this Website for marketing purposes, either through text messages, emails or on social media sites.
7. Intellectual Property
7.1 Flower Bliss is a registered trademark of Flower Bliss Limited. This entire website, copy, images, logos, indicia, text, content, and unique method of showcasing products is owned by Flower Bliss Limited.
7.2 All trademarks appearing herein are acknowledged. Permission to use documents delivered from this World Wide Web site and/or server and related graphics is restricted.
7.3 The name of Flower Bliss or any of the above trademarks or logos may not be used in advertising or publicity pertaining to distribution of this information without specific, written prior permission.
8.1 Flower Bliss Limited shall reserve the right to supplement and amend the Terms and Conditions from time to time.
8.2 It is the Customer’s responsibility to review the Terms and Conditions on this site and any acceptance of the Terms and Conditions, it shall be assumed that the customer has full knowledge and understanding of these Terms and Conditions.
8.3 Flower Bliss reserves the right to suspend, restrict or terminate access to the Online Site and/or the Online Services for any reason at any time.
8.4 These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Online Site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8.5 Save in respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.
8.6 Flower Bliss does not warrant the quality of the products, shelf life, vase life or suitability for purpose.
8.7 In no event shall Flower Bliss be liable for any indirect, special, incidental or consequential damages incurred through the delivery of the products. Despite the foregoing, Flower Bliss liability is limited to the contract price of the particular order.
8.8 The subject terms and conditions shall apply for all our branches in Kenya ,which include and not limited to;
